This Policy applies to visitors, registered users, buyers, tenants, investors, property owners, developers, agents, affiliates, professional advisers, service providers, business partners and other persons whose personal data is processed through Briccex.
Where a third party independently determines how and why it processes your data, that party acts as a separate data controller and its own privacy policy will apply.
3. Personal Data We Collect
We collect only the information reasonably required to operate, secure and improve Briccex, meet legal obligations and complete requested transactions.
| Category | Details |
|---|---|
| Identity and account data | Full name, date of birth, gender where relevant, username, password, profile photograph and account identifiers. |
| Contact data | Email address, telephone number, residential or business address and communication preferences. |
| Verification and KYC data | National identification number, passport, driver’s licence, voter’s card, BVN where lawfully required, proof of address, selfie or liveness checks, source-of-funds information and screening results. |
| Property and listing data | Property ownership documents, title records, location, photographs, videos, valuation information, inspection details, tenancy information and communications relating to a listing. |
| Transaction and financial data | Payment references, transaction history, wallet activity, escrow status, invoices, receipts, payout instructions, bank account details and information required to process or reconcile payments. We do not ordinarily store complete payment-card credentials where payment is handled by a regulated payment provider. |
| Investment-related data | Investment preferences, eligibility information, subscription records, certificates, holdings, distributions, risk acknowledgements and information needed for regulatory or suitability checks. |
| Technical and usage data | IP address, browser and device information, operating system, login activity, pages viewed, search history, clickstream, diagnostic logs, cookies and similar technologies. |
| Communications and support data | Messages, calls, complaints, enquiries, survey responses and records of interactions with our support or compliance teams. |
| Professional and business data | Company name, role, business registration details, professional licence, tax information and due-diligence records for developers, agencies, vendors or partners. |
We may also receive information from identity-verification providers, payment processors, banks, property professionals, public records, government agencies, fraud-prevention services, marketing partners, referral partners and other users who lawfully provide it.
4. How We Use Personal Data
We may use personal data to:
| • | Create, authenticate and manage user accounts. |
|---|---|
| • | Verify identity, conduct KYC, anti-money-laundering, sanctions, fraud and risk checks where applicable. |
| • | Publish, review, verify, administer and promote property listings. |
| • | Process purchase, rental, investment, wallet, escrow, payment, settlement and payout activities. |
| • | Generate transaction records, invoices, receipts, certificates and account statements. |
| • | Connect users with property owners, developers, agents, professionals or approved partners where required to fulfil a request. |
| • | Provide support, resolve complaints and communicate service, security or transaction updates. |
| • | Personalise search results and improve platform functionality, reliability and user experience. |
| • | Detect, investigate and prevent fraud, misuse, account compromise and other prohibited conduct. |
| • | Comply with legal, regulatory, tax, audit, reporting, court and law-enforcement requirements. |
| • | Send marketing communications where permitted and manage consent or opt-out preferences. |
| • | Establish, exercise or defend legal claims and enforce our agreements. |
5. Lawful Bases for Processing
Depending on the circumstances, we process personal data on one or more of the following grounds:
| Category | Details |
|---|---|
| Contract | Processing required to provide an account, respond to your request or perform a transaction or agreement with you. |
| Consent | Processing based on a clear and voluntary choice, including certain marketing, cookies, sensitive information or optional features. Consent may be withdrawn, subject to lawful limitations. |
| Legal obligation | Processing required to comply with applicable laws, regulatory requirements, lawful requests, record-keeping, taxation, KYC, anti-fraud or anti-money-laundering duties. |
| Legitimate interests | Processing reasonably necessary to operate and secure the platform, improve services, prevent fraud, manage business relationships, analyse performance or protect legal rights, provided those interests do not override your rights. |
| Public interest or vital interests | Processing necessary in limited circumstances to protect a person, prevent serious harm or perform a task recognised by law. |
6. KYC, Identity and Fraud Prevention
Certain Briccex services may require enhanced verification before a transaction, listing, rental, payout or investment activity can proceed. We may use specialised service providers to validate identity documents, confirm liveness, screen sanctions or politically exposed persons, verify bank details and assess fraud or compliance risk.
We may restrict, suspend or refuse an account or transaction where required information is not supplied, cannot be verified, appears fraudulent, or creates an unacceptable legal or security risk. We will not use sensitive identity information for unrelated advertising.
7. Property Listings and User Content
Information submitted for a public property listing may be visible to users and search engines. Public listing information may include property photographs, location, price, features, developer or agency identity and approved contact details.
Do not upload personal data, documents or images that you are not authorised to provide. Ownership documents, identity records and confidential due-diligence materials will not be made public unless disclosure is necessary, lawful and clearly communicated.
8. Payments, Wallets and Escrow
Payments may be processed by banks, payment service providers, escrow providers or other regulated partners. These providers may receive information required to authorise, process, reconcile, refund or investigate a payment.
Briccex may retain payment references, account details, transaction status, invoices and settlement records. Complete card numbers, security codes or online-banking credentials should be entered only into the secure interface of the relevant payment provider.
10. Automated Processing
We may use automated tools to support fraud detection, identity verification, risk screening, search ranking, recommendations or transaction monitoring. These tools may flag an activity for human review.
Where a decision produces a legal or similarly significant effect and is based solely on automated processing, we will provide applicable safeguards, including the ability to request human review, express your position or challenge the decision where required by law.
12. International Data Transfers
Some service providers or technical infrastructure may process information outside Nigeria. Before transferring personal data internationally, we will use a lawful transfer mechanism and assess whether the destination or recipient provides an adequate level of protection.
Where appropriate, safeguards may include contractual obligations, security measures, transfer assessments, consent where valid, or another mechanism permitted under Nigerian data protection law.
13. Data Security
We apply proportionate technical and organisational measures designed to protect personal data against unauthorised access, alteration, disclosure, loss or destruction. Measures may include encryption, access controls, secure development practices, monitoring, backups, staff confidentiality, vendor due diligence and incident-response procedures.
No internet or storage system is completely secure. Users are responsible for keeping login details confidential, using strong passwords and notifying us promptly of suspected unauthorised access.
14. Data Retention
We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, to complete transactions, maintain accurate records, resolve disputes, prevent fraud and comply with legal, regulatory, tax and audit obligations.
Retention periods vary according to the type of record and applicable requirements. Data may be deleted, anonymised or securely archived when it is no longer required. Some records may be retained after account closure where necessary to meet legal obligations or establish, exercise or defend claims.
15. Your Privacy Rights
Subject to applicable law and lawful limitations, you may have the right to:
| • | Be informed about how your personal data is processed. |
|---|---|
| • | Request access to personal data held about you. |
| • | Request correction of inaccurate or incomplete data. |
| • | Request deletion where there is no lawful reason to continue processing. |
| • | Object to certain processing, including direct marketing. |
| • | Request restriction of processing in appropriate circumstances. |
| • | Withdraw consent without affecting processing already lawfully carried out. |
| • | Request data portability where applicable. |
| • | Request safeguards concerning certain automated decisions. |
| • | Lodge a complaint with the Nigeria Data Protection Commission. |
To exercise a right, contact us using the details in Section 22. We may need to verify your identity and may request information necessary to locate and assess the relevant records. We aim to respond within the period required by applicable law.
16. Marketing Communications
We may send service-related messages that are necessary for your account or transaction. Where permitted, we may also send marketing about properties, platform features, events or partner opportunities.
You may unsubscribe from marketing using the link in the message or by contacting us. Opting out of marketing does not stop essential account, security, legal or transaction communications.
17. Children’s Privacy
Briccex is not intended for persons under 18 years of age to independently enter property or investment transactions. We do not knowingly create transactional accounts for children without a lawful basis and appropriate consent or authorisation.
If you believe a child has submitted personal data without appropriate authorisation, contact us so that we can investigate and take suitable action.
18. Third-Party Links and Services
Briccex may contain links to websites, applications or services operated by third parties. We are not responsible for their privacy practices. Review the privacy notice of each third party before providing personal data.
19. Data Breaches and Incident Response
We maintain procedures to assess and respond to suspected personal-data breaches. Where required by law, we will notify the Nigeria Data Protection Commission and affected individuals within the applicable timeframe, taking account of the nature and risk of the incident.
20. Changes to This Privacy Policy
We may update this Policy to reflect changes in our services, technology, legal obligations or business practices. The revised version will be posted on briccex.com with a new “Last Updated” date. Where a change materially affects your rights, we may provide additional notice through the platform or by email.
21. Complaints
Please contact us first so we can review and address your concern. You also have the right to submit a complaint to the Nigeria Data Protection Commission through its official channels.
